Legislators in the state of Nevada have introduced a measure to legalize psilocybin and promote studies into the psychedelic while also encouraging research on MDMA. The measure, introduced by Senator Rochelle Nguyen, is mainly designed to streamline the process of conducting research on MDMA and psilocybin. It also contains language eliminating civil and criminal penalties for adults who grow, possess or share up to four ounces of psilocybin.
Under the legislation, scientists would submit applications to research psychedelics to the state Department of Health and Human Services. The research part of the measure also offers legal protections against prosecution at the state level for individuals involved in such studies, including those conducting the research as well as the participants.
All studies would have to focus on the possible mental health applications of the substances, including the treatment of anxiety, depression, bipolar disorder, post-traumatic stress disorder and migraines.
The measure stipulates that research has shown that MDMA and psilocybin may be effective in treating various behavioral health conditions, noting that the state of Nevada had a high prevalence of adults with behavioral health conditions. Another section of the measure would also legalize the use of psilocybin for individuals aged 18 and above.
Nevada becomes the latest state to jump on the bandwagon to pursue psychedelics reform in the country, as interest in the therapeutic potential of these substances grows. For instance, legislators in Vermont recently filed a measure to decriminalize and legalize psychedelics for adults. In Texas, legislators filed some measures to expand and promote research on entheogenic substances in the state.
Last week, a committee in Rhode Island held a hearing on a measure that would eliminate penalties for the possession and use of psilocybin. The measure would also permit the home growing of psilocybin mushrooms for personal use. That same day, the House of Representatives in Oklahoma passed a resolution to promote studies into the therapeutic potential of psilocybin. The initiative also offers legal protections against the prosecution of individuals with eligible conditions found in possession of psilocybin.
This comes after both the Senate and House in the state of Hawaii approved three psychedelics research measures. In addition to this, legislators in Missouri advanced a measure in committee earlier this month that would facilitate studies into the therapeutic potential of some psychedelics, including ketamine, MDMA and psilocybin. A recently conducted analysis concluded that most states in the nation will have legalized psychedelics by 2037.
